PALFIT Pty Ltd (ABN 71 663 576 476) trading as ATÓRA Training Cremorne ("ATÓRA", "we", "us" or "our") operates atora.training and the ATÓRA Training Cremorne studio. This page sets out, in two parts, both our Privacy Policy (how we handle your personal information) and our Terms of Use & Conditions (the terms that apply to trials and memberships).

By using our websites (including atora.training and our trial and checkout pages), signing up for a trial, or becoming a member, you agree to the collection, use and disclosure of your information as described in Part 1, and to the terms set out in Part 2.

02How we collect your information

We collect personal information directly from you - through our website forms, our checkout, in person at the studio, by phone, email or social media. We also collect information automatically through cookies and tracking technologies when you use our websites, and we may receive information from the third parties described above. Where it is reasonable and practicable, we collect personal information directly from you.

04Cookies and tracking technologies

Our websites use cookies and similar technologies to remember your preferences, understand how our pages are used, and measure the performance of our advertising.

We use the Meta Pixel and Meta's Conversions API. When you submit a trial or checkout form, or take certain actions on our pages, we may share event data - including a hashed (irreversible) version of contact details such as your email - with Meta Platforms so that we can measure ad performance and reach relevant audiences. This data is matched by Meta in hashed form.

You can manage cookies through your browser settings, control ad personalisation through your Meta ad preferences, and opt out of interest-based advertising through Your Online Choices Australia. Disabling cookies may affect how our websites work.

06Overseas disclosure

Some of our service providers (including Meta Platforms and certain hosting and infrastructure providers) are located in, or store data in, countries outside Australia, including the United States. Where we disclose your information overseas, we take reasonable steps to ensure it is handled in accordance with the Australian Privacy Principles. By providing your information, you consent to these overseas disclosures.

07Direct marketing and communications

Where you have consented, we may send you marketing communications by email or SMS about offers, classes, events and updates. Every marketing message includes a simple way to opt out, and we comply with the Spam Act 2003 (Cth). You can unsubscribe or update your preferences at any time by using the opt-out in any message or by contacting us. We may still send you non-marketing messages necessary to administer your trial or membership.

08How we keep your information secure

We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure - including access controls and encryption of data in transit. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

09How long we keep it

We keep your personal information only for as long as we need it for the purposes described in this policy, or as required by law. When it is no longer needed, we take reasonable steps to destroy or de-identify it.

10Accessing and correcting your information

You have the right to request access to the personal information we hold about you and to ask us to correct it if it is inaccurate, out of date or incomplete. To make a request, contact us using the details below. We may need to verify your identity, and in limited circumstances permitted by law we may decline a request (we will tell you why). We do not usually charge for correcting information; a reasonable cost may apply for providing access.

We will acknowledge your complaint and aim to respond within 30 days. Our services and websites are intended for adults aged 18 and over. Where a person under 18 trains with us, we collect their information with the consent of a parent or guardian.

Our websites may contain links to third-party sites. We are not responsible for the privacy practices or content of those sites, and we encourage you to read their privacy policies.

14Changes to this policy

We may update this Privacy Policy from time to time. The current version will always be available on this page, and the "Last updated" date above will reflect any changes. Where changes are material, we will take reasonable steps to notify you.

Part 2
Terms of Use
& Conditions

The terms that apply to your trial and membership with ATÓRA Training Cremorne.

15Changes to these terms

ATÓRA Training reserves the right to change conditions of membership, hours of operation, services offered and all fees and charges, at any time, at its sole discretion, with reasonable notice. Any such changes will be notified to you through either the website or by email to your last known email address.

16Code of conduct

By submitting a trial or membership form, you agree to be bound by the ATÓRA Training Code of Conduct.

17Membership fees

By providing a payment method for your membership, you explicitly give ATÓRA Training the authority to charge your membership fee on a weekly basis according to the term of your subscription. Payments are normally processed on the day of the week on which you join.

There is a one-time account setup fee of $15. The total cost of the membership will include a one-time payment gateway processing fee of $2 on the first payment, in addition to the above cost. Payments are subject to a weekly processing fee dictated by the payment method of your choosing. All costs include GST.

On each occasion that a scheduled payment is declined for any reason, we will continue to attempt to process the payment each day after. If payments continue to fail, the member's ability to book classes will be limited. Failed payments will incur a $3.85 failed payment charge in addition to the weekly cost of the membership.

The minimum term for a 6 month membership is a total of 26 weekly payments. Any suspensions or time free does not count towards the 6 months.

19Cancellation policy

Flexi Membership: you may cancel your membership at any time with two weeks' notice, after the first month of membership is complete.

To notify ATÓRA Training of a cancellation, send an email to cremorne@atoratraining.com that details your name, the email we have on file for you, your requested cancellation date, and your reason for cancelling.

20Account suspensions

You may pause your membership for up to a maximum of 4 weeks within a 6 month period by providing written notice to ATÓRA Training. Suspensions are to be used on a 7, 14, 21 or 28 day basis and must start back in line with your normal membership payment collection date. Suspensions require an exact return date for the pause.

Should any payments, fees or other debts remain due but unpaid from any source, ATÓRA Training may suspend your use of the services until all fees and other debts are paid in full.

21Liability waiver and indemnity

ATÓRA Training is in no way responsible for the safekeeping of your personal belongings while you attend class.

You understand that classes at ATÓRA Training may be physically strenuous and have inherent dangers and risks, and you voluntarily participate in them with full knowledge that there is a risk of personal (physical and mental) injury, property loss or death.

By submitting a trial or membership form, you agree that you, your heirs, assigns or legal representatives hereby release ATÓRA Training and their owners, volunteers, directors, officers, employees, trainers and independent contractors from any claims of any kind whatsoever for any personal injury, property damage or loss, or wrongful death, whether caused by negligence or otherwise.

You also agree to hold harmless and indemnify ATÓRA Training and their owners, volunteers, directors, officers, employees, trainers and independent contractors from any liability for property damage or personal injury which a third party may suffer as a result of you participating in classes at ATÓRA Training.
